These Terms & Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of the AiPowerHost website, hosting services, domain registration services, VPS/cloud services, email services, website services, and other products or services offered by AiPowerHost (“Company”, “AiPowerHost”, “we”, “us”, or “our”).

By accessing our website or purchasing/using any of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

“Account” means the customer account created with AiPowerHost.
“Server” means any physical or virtual server, hosting environment, VPS, cloud infrastructure, or related infrastructure provided to the customer.
“Content” means all files, websites, databases, emails, applications, text, images, videos, software, and other data uploaded or stored by the customer.

2. Acceptance of Terms

By registering an account, placing an order, making a payment, or using any AiPowerHost service, you confirm that:

You have read and understood these Terms.
You agree to comply with these Terms.
The information provided by you is accurate and complete.
You are legally capable of entering into an agreement.
You will comply with all applicable laws and regulations.

AiPowerHost may modify these Terms from time to time. Updated Terms may be published on our website, and continued use of our services after changes are published constitutes acceptance of the updated Terms.

3. Account Registration

Customers may be required to create an account before purchasing certain services.

You agree to:

Email hosting

Specific features, resource limits, uptime commitments, and other conditions may vary depending on the selected plan.

Customers are responsible for ensuring that their websites and applications are compatible with the hosting environment.

5. Acceptable Use Policy

AiPowerHost services must be used only for lawful purposes.

You must not use our infrastructure to:

Host or distribute illegal content.
Conduct phishing, scams, fraud, or deceptive activities.
Distribute malware, viruses, ransomware, spyware, or other malicious software.
Conduct unauthorized hacking or security attacks.
Perform DDoS or other disruptive attacks.
Send spam or unsolicited bulk email.
Host content that infringes copyright, trademarks, or other intellectual property rights.
Operate illegal gambling or fraudulent financial services.
Store or distribute stolen credentials, payment card information, or other unlawfully obtained data.
Operate services intended to attack, compromise, or disrupt third-party systems.
Host content that violates applicable laws or regulations.

AiPowerHost may investigate suspected violations and may suspend or terminate affected services when reasonably necessary.

6. Resource Usage

Hosting plans may have limitations relating to:

CPU usage
RAM usage
Storage
Bandwidth
Inodes/files
Database resources
Email sending
Concurrent processes
Server connections

Customers must use resources reasonably and in accordance with their selected plan.

If a website or application consumes excessive resources and negatively affects server performance or other customers, AiPowerHost may contact the customer and may require an upgrade, optimization, limitation, suspension, or migration of the service.

7. Domain Registration

Domain registration and renewal services may be provided through third-party domain registries and/or registrars.

Domain registrations are subject to the policies and rules of the applicable domain registry.

You acknowledge that:

Domain availability is not guaranteed until registration is successfully completed.
Domain names are generally registered on a first-come, first-served basis.
Registration information must be accurate.
Certain domains may have additional eligibility requirements.
Domain registration fees may be non-refundable after successful registration.
Renewal fees must be paid before the applicable renewal deadline.

AiPowerHost does not guarantee that a requested domain name will always remain available.

8. Domain Renewal and Expiration

Customers are responsible for renewing their domains before expiration.

Failure to renew a domain may result in:

Domain expiration
Website/email interruption
Additional restoration fees
Domain suspension
Loss of the domain name

AiPowerHost may provide renewal reminders as a convenience, but customers remain responsible for ensuring timely renewal.

9. Payments and Billing

All services must be paid for according to the applicable pricing displayed at the time of purchase.

Unless otherwise stated:

Services are activated after successful payment verification.
Recurring services must be renewed before the due date.
Taxes and applicable government charges may be added where required.
Promotional prices may apply only for the initial billing period.
Renewal prices may differ from introductory prices.

AiPowerHost reserves the right to change pricing with reasonable notice where applicable.

10. Late Payment and Suspension

If payment is not received by the due date, AiPowerHost may:

Send payment reminders.
Suspend the affected service.
Restrict access to the service.
Terminate the service after an applicable grace period.
Delete service data after termination in accordance with our policies.

Reactivation or restoration may require payment of outstanding invoices and applicable restoration charges.

11. Refund Policy

Refund eligibility depends on the specific service purchased and the applicable refund policy displayed at the time of purchase.

Unless otherwise expressly stated:

Domain registration and domain renewal fees are generally non-refundable after successful registration or renewal.
Third-party licenses, paid add-ons, setup fees, and certain infrastructure services may be non-refundable.
Refunds may be denied where the service has been abused or violated these Terms.
Promotional or discounted services may have separate refund conditions.

Where a refund is approved, it may be processed using the original payment method or another method selected by AiPowerHost where appropriate.

12. Backups and Data Responsibility

Customers are responsible for maintaining independent backups of their important data.

Although AiPowerHost may provide backups for certain services, backups are provided as a precaution and are not guaranteed to be available at all times.

AiPowerHost shall not be responsible for loss of data caused by:

Customer actions
Software failures
Security incidents
Account suspension or termination
Hardware failure
Configuration errors
Application bugs
Malware
Circumstances beyond our reasonable control

Customers should maintain their own external backups of critical websites, databases, emails, and files.

13. Server Security

Customers are responsible for securing applications and accounts hosted under their services.

This includes:

Keeping software updated.
Using strong passwords.
Installing security updates.
Maintaining secure CMS installations.
Removing unused plugins and software.
Protecting administrative accounts.
Monitoring suspicious activity.

AiPowerHost may take reasonable protective measures when a customer’s service poses a security risk to our infrastructure or other users.

14. Email Services and Spam

Email services must not be used for unsolicited bulk messaging, spam, phishing, malware distribution, or other abusive activities.

AiPowerHost may restrict, suspend, or terminate email services where abnormal sending activity or abuse is detected.

Customers are responsible for maintaining the reputation and security of their domains and mailboxes.

15. SSL Certificates

Where SSL certificates are offered, issuance and validation may depend on third-party certificate authorities.

AiPowerHost does not guarantee issuance of a certificate where domain validation or other required verification cannot be completed.

Customers are responsible for providing accurate information required for SSL issuance.

16. VPS and Cloud Services

VPS and cloud services provide customers with greater control over their server environment.

Customers may be responsible for:

Operating system configuration
Server security
Software installation
Firewall configuration
Application security
Backups
Updates
Server administration

Unless specifically included in the purchased plan, AiPowerHost does not guarantee that managed server administration or application-level support will be provided.

17. Intellectual Property

All AiPowerHost trademarks, logos, website content, graphics, designs, text, software, and other proprietary materials remain the property of AiPowerHost or their respective owners.

Customers receive only the rights necessary to use purchased services.

You may not copy, reproduce, modify, distribute, sell, or commercially exploit AiPowerHost proprietary materials without prior written permission.

Customers retain ownership of their own lawful content uploaded to our services.

18. Third-Party Services

AiPowerHost may integrate with or resell third-party services, including domain registries, payment gateways, software providers, SSL providers, cloud infrastructure providers, and other service providers.

Third-party services may be subject to additional terms and policies.

AiPowerHost is not responsible for changes, outages, pricing, or policies imposed by independent third-party providers beyond our reasonable control.

19. Service Availability

AiPowerHost aims to provide reliable services but does not guarantee uninterrupted or error-free availability unless a specific service-level agreement (“SLA”) expressly provides otherwise.

Service availability may be affected by:

Scheduled maintenance
Emergency maintenance
Hardware failures
Network failures
Data center issues
Cybersecurity incidents
Internet infrastructure problems
Third-party provider failures
Events beyond our reasonable control

Any uptime guarantee, if applicable, will be governed by the specific SLA associated with the relevant service.

20. Maintenance

AiPowerHost may perform scheduled or emergency maintenance to maintain, upgrade, secure, or improve its infrastructure.

Where reasonably possible, scheduled maintenance will be communicated in advance.

Emergency maintenance may occur without prior notice when necessary to protect infrastructure, customer data, or service availability.

21. Suspension and Termination

AiPowerHost may suspend or terminate services where reasonably necessary due to:

Non-payment
Violation of these Terms
Abuse of resources
Illegal activity
Security threats
Fraudulent activity
Spam or network abuse
Copyright or intellectual-property complaints
False account information
Activities that negatively affect other customers or infrastructure

Upon termination, access to the affected service may be permanently removed.

Customers should maintain their own backups before termination or cancellation.

22. Abuse and Legal Complaints

AiPowerHost may cooperate with valid legal requests, law-enforcement requirements, court orders, and legitimate intellectual-property complaints where required by applicable law.

Where appropriate and legally permitted, customers may be contacted regarding complaints involving their services.

23. Limitation of Liability

To the maximum extent permitted by applicable law, AiPowerHost shall not be liable for indirect, incidental, special, consequential, or loss-of-profit damages resulting from the use or inability to use our services.

This includes, without limitation:

Loss of revenue
Loss of business
Loss of customers
Loss of data
Loss of reputation
Website downtime
Application failure
Email delivery issues
Third-party service failures

Our total liability relating to a service shall, to the extent permitted by applicable law, be limited to the amount actually paid by the customer for the affected service during the applicable period.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

24. Indemnification

You agree to indemnify and hold AiPowerHost, its owners, employees, affiliates, and service providers harmless from claims, damages, liabilities, losses, costs, or expenses arising from:

Your use of our services.
Your violation of these Terms.
Your violation of applicable laws.
Your content or applications.
Your infringement of third-party rights.
Unauthorized or abusive activities conducted through your account.

25. Force Majeure

AiPowerHost shall not be responsible for delays, interruptions, or failures caused by circumstances beyond its reasonable control.

Support availability and response times may vary depending on the service plan and support channel.

Support does not necessarily include custom application development, third-party software troubleshooting, or server administration unless specifically included in the purchased service.

28. Changes to Services

Change infrastructure providers.
Change pricing.
Discontinue services where reasonably necessary.

29. Governing Law and Jurisdiction

Subject to applicable law, disputes relating to these Terms or AiPowerHost services shall be subject to the jurisdiction of the competent courts having jurisdiction over the Company’s applicable place of business in India.

30. Severability

31. Entire Agreement

These Terms, together with any applicable service-specific terms, Privacy Policy, Refund Policy, Acceptable Use Policy, and applicable SLA, constitute the agreement between you and AiPowerHost regarding the relevant services.
